1. Services provided
FitVault provides one-on-one personal training, program design, and related coaching services delivered in person at Plus Fitness Milperra (Unit 1/211 Beaconsfield Street, Milperra NSW 2214). FitVault does not provide medical advice, physiotherapy, dietetics, or psychological services. Where these are needed, you will be referred to an appropriate qualified professional.
2. Client eligibility
- You must be 18 years of age or older to enter into this agreement directly. Clients under 18 require written parental or guardian consent.
- You must hold a current Plus Fitness membership. FitVault sessions are conducted within the Plus Fitness Milperra facility, and gym access is your responsibility.
- You must complete the FitVault Client Intake Form, including the PAR-Q health screening, before your first paid session. Free trial sessions also require a completed intake form.
- If you answer Yes to any PAR-Q question, you must obtain medical clearance from a qualified physician before training commences.
3. Packages and pricing
Current packages and pricing are as follows:
- Free Trial — 1 session, $0. One per person. Includes a movement assessment and goal consultation.
- Single Session — $100 (or $80 cash).
- Kickstart — 10 sessions over 5 weeks, $1,000 (or $800 cash).
- Transform — 20 sessions over 10 weeks, $2,000 (or $1,600 cash).
- Elite — 40 sessions over 20 weeks, $4,000 (or $3,200 cash).
All paid packages must be paid in full before sessions commence. Sessions purchased as part of a package are valid for 6 months from the date of purchase and expire if unused. Pricing is inclusive of all applicable taxes for a sole trader operating below the GST threshold.
4. Cash discount
A 20% discount applies to all packages (excluding the Free Trial) when payment is made in cash directly to Hassan Nafeh at the time of purchase. All cash payments are issued with a written or digital receipt and are recorded for tax compliance purposes.
5. Cancellation and rescheduling
- 24+ hours notice — You may reschedule the session at no charge, subject to availability.
- Less than 24 hours notice — 50% of the session value is forfeited.
- No-show — The full session value is forfeited and the session is treated as completed.
- Trainer-initiated cancellation — In the event Hassan must cancel due to illness, emergency, or unforeseen circumstances, the session will be rescheduled at no charge and no penalty applies.
6. Refunds
Packages are non-refundable except where required by Australian Consumer Law. If you cease training partway through a package due to medical reasons supported by a written letter from a qualified medical practitioner, unused sessions may, at FitVault's discretion, be paused for up to 6 months or refunded on a pro-rata basis less an administration fee equal to one full session value.
7. Health, safety and assumption of risk
You agree to:
- Disclose all relevant health conditions, injuries, and medications honestly on the intake form.
- Inform Hassan immediately if your health status changes during the training relationship.
- Stop any exercise that causes pain or unusual discomfort and inform Hassan immediately.
- Wear appropriate athletic clothing and footwear to all sessions.
- Follow all instructions given during sessions, including form cues and load adjustments.
8. Limitation of liability
To the maximum extent permitted by Australian law, FitVault and Hassan Nafeh exclude liability for any injury, loss, or damage arising from personal training services, except where such injury, loss, or damage is caused directly by the gross negligence of Hassan Nafeh. The detailed liability waiver signed as part of the Client Intake Form forms part of these terms by reference.
This limitation does not exclude or limit any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Privacy
Your personal and health information is handled in accordance with the FitVault Privacy Policy, which forms part of these terms.
10. Confidentiality and content
FitVault treats all client information confidentially. Photographs, transformation results, or testimonials will only be shared publicly (e.g. on social media or this website) with your explicit written consent.
11. Termination
Either party may terminate the training relationship at any time. If FitVault terminates the relationship for reasons other than client misconduct, unused sessions will be refunded on a pro-rata basis. If you terminate for personal reasons, refund eligibility is governed by clause 6.
FitVault reserves the right to terminate the relationship immediately, without refund, in cases of: client violence or abuse, dishonesty about health status that creates safety risk, persistent no-shows (3 or more), or violation of Plus Fitness Milperra facility rules.
12. Changes to these terms
FitVault may update these terms from time to time. The current version always applies and is published at fitvault.com.au/terms. Material changes will be communicated to active clients by email at least 14 days before they take effect.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
